Child Care Legislation

Legislation

There are various New South Wales Acts and Regulations pertaining to the care of children and young persons. The primary Act and Regulation, relating to Centre Based Children’s Services are:-

  • Children & Young Persons (Care and Protection) Act 1998 No 157 (the ‘Act’)
  • Children’s Services Regulation 2004 (the ‘Regulation’)

Community Services (formerly Department of Community Services) enforces regulations in relation to centre operations and licensing.

The Act and Regulation were last amended on January 7, and 1, 2011 respectively. These amendments followed research conducted by the Australian Government, in partnership with all State and Territory Governments, collectively known as the Council Of Australian Governments (COAG). COAG has introduced a National Quality Framework for Early Childhood Education and Care.

The National Quality Framework, was put in place to ensure high quality and consistent early childhood education and care across Australia for long day care, family day care, outside school hours care and preschools. This is proposed to be achieved by improving quality through:-
